Bankruptcy is a major step and it is not something that you should enter into lightly. There are very serious consequences to declaring bankruptcy. Because of that before you are allowed to file for bankruptcy you are required by law to enter into bankruptcy counseling. At the end of this you will be given a certificate that you are required to present when you are filing for bankruptcy. The purpose of this counseling is to make sure that you understand how the bankruptcy procedure works, the consequences of bankruptcy and whether or not it is really necessary or if you have other options.
The biggest thing that will be covered during bankruptcy counseling is looking to see if you have other options. A lot of people rush into bankruptcy because they think that it is an easy solution to their problems, it isn't. Bankruptcy is a last resort you will likely have other options that would be better for you long term. In most cases the other options are going to take quite a bit of sacrifice on your part. However if you can at all work out a plan that will allow you to pay off your bills you should do just that.
The reason that you want to pay off your bills if you can is that here are some very serious consequences to bankruptcy. This will be covered during your counseling session. A bankruptcy will stay on your credit report for the next seven years and it will make it impossible for you to get a loan during that time. It will also affect your ability to get an apartment or even to get a job. Many landlords and employers will check your credit and if there is a bankruptcy on there you are likely going to have a problem.
If you decide that you understand the consequences and you have no other options then you will need to understand how the process works. This will be covered during your counseling. You will go over the basics of bankruptcy and what the laws are and how the process works. Keep in mind that this will be just general advice, you counselor won't be able to advise you specifically on your case. If you need that kind of assistance you will want to talk to a bankruptcy lawyer who will be able to get into all of the details of your case.
